End User License Agreement

1. Acceptance of this agreement

This End User License Agreement ("EULA") is a legal agreement between you and Marius Mocanu, the individual developer of WiseCloq ("we", "us", "the developer"), governing your use of the WiseCloq Android application (the "App"). By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not install or use the App.

2. License grant

Subject to your compliance with this EULA, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use one copy of the App, in compiled (object code) form only, on Android devices that you own or control, solely for your own personal, non-commercial record-keeping purposes.

This license is granted to you individually and does not extend to any other person, even if they use a device you own. It does not transfer any ownership of the App to you.

3. Restrictions

Except to the extent expressly permitted by applicable law notwithstanding this restriction, you agree not to:

• Copy, modify, translate, or create derivative works of the App;
• Reverse-engineer, decompile, or disassemble the App, or attempt to derive its source code;
• Rent, lease, lend, sell, redistribute, sublicense, or otherwise transfer the App or your license to it to any third party;
• Remove, obscure, or alter any proprietary notices on or within the App;
• Use the App for any unlawful purpose, or in a way that infringes any third party's rights, including your employer's policies on confidential or proprietary information; or
• Use the App to build a competing product.

4. Ownership & third-party components

The App, including its source code, design, structure, and all associated intellectual property, is owned by Marius Mocanu. This EULA grants you a license to use the App — it does not sell you any rights in it. All rights not expressly granted are reserved.

The App is also built on standard AndroidX / Jetpack Compose / Kotlin libraries, each under its own respective open-source license. See our Privacy Policy (section 4) for what QR Check does with each of these.

5. Your content

Any information you type into the App — names, shift data, remarks, and similar entries ("Your Content") — remains yours. We claim no ownership over it. As explained in our Privacy Policy, Your Content is stored locally on your device; we have no copy of it and no access to it.

6. No warranty

In particular: pay, bonus, and hours estimates calculated by the App are unofficial estimates only, based on formulas and rates you configure yourself. They are not official payroll, wage, tax, or legal advice, may contain errors or bugs, and must always be independently verified against your employer's official pay records before you rely on them for any purpose. We do not warrant that the App will be error-free, uninterrupted, or that it will meet your requirements.

The QR Check feature specifically depends on APCOA's own servers responding correctly (see our Privacy Policy, section 4) — we have no control over those servers and cannot guarantee they will be available, unchanged, or error-free.

7. Limitation of liability

To the maximum extent permitted by applicable law, in no event will Marius Mocanu be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of income, profits, or data, arising out of or related to your use of (or inability to use) the App — including, without limitation, any financial decision made in reliance on a pay or bonus estimate the App produced, or any discrepancy between that estimate and your actual pay.

To the extent any liability cannot be excluded under applicable law, our total aggregate liability arising out of or relating to the App will not exceed the amount you paid for it (which, for a free app, is zero).

Nothing in this EULA limits any liability that cannot be limited under applicable law, and nothing here affects any statutory rights you may have as a consumer that cannot be waived by agreement.

8. Term & termination

This EULA is effective from the moment you install the App and remains in effect until terminated. It terminates automatically, without notice, if you fail to comply with any of its terms. You may terminate it at any time by uninstalling the App. Upon termination, the license granted in section 2 ends immediately; sections 3 through 13 survive termination.

We may discontinue the App, or stop providing updates or support for it, at any time and for any reason, without liability to you.

9. Updates

We may release updates to the App through Google Play from time to time. Some updates may change how data is stored, calculated, or displayed, or may change or remove features. This EULA applies to all updates unless a different license is provided with a particular update.

10. Your legal compliance

You are responsible for ensuring that your use of the App — including any pay, bonus, or work-record data you log — complies with your employer's own policies and with the laws that apply to you, wherever you are located.

11. Governing law

This EULA is governed by the laws of Romania, without regard to conflict-of-law principles, except that if you are a consumer habitually resident in the European Union, the United Kingdom, or another jurisdiction whose law does not permit this choice to deprive you of mandatory consumer protections, those mandatory protections continue to apply.

12. General terms

If any provision of this EULA is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. This EULA, together with our Terms & Conditions and Privacy Policy, constitutes the entire agreement between you and us regarding the App, and supersedes any prior agreements on the subject. We may update this EULA from time to time; the "Last updated" date above will reflect the most recent version, and continued use of the App after an update constitutes acceptance of the revised EULA.
